  1. PRODUCTS

Black Cobra Miniatures sells downloadable digital files, primarily STL files and related digital content for tabletop miniatures and scenery.

No physical product will be shipped unless a product page expressly states otherwise. Product images may show rendered or printed examples for illustration.

Customers are responsible for checking the product description, included files, scale, supported or unsupported status, software compatibility and printing requirements before purchase.

  1. ORDER PROCESS

To place an order, the customer selects the desired products, reviews the cart, provides the required billing and contact information, chooses an available payment method and confirms the order.

Before submitting the order, the customer can review and correct the information entered. An order confirmation will be sent electronically after the purchase is received.

The contract is concluded when the order is accepted and confirmed. Black Cobra Miniatures may reject or cancel an order in cases of manifest pricing error, payment failure, suspected fraud, unlawful use or technical error. Any amount already collected for a cancelled order will be refunded.

  1. PRICES AND TAXES

Prices are displayed in the currency shown on the website and include or exclude applicable taxes as indicated during checkout.

The final amount, including any applicable taxes, is displayed before the customer places the order. The tax treatment may depend on the customer’s location and status.

  1. PAYMENT

Available payment methods may include:

  • WooPayments, including supported credit or debit cards, Apple Pay, Google Pay and other methods made available at checkout.
  • PayPal.

Payments are processed by the selected payment provider. Black Cobra Miniatures does not directly store complete payment-card details.

  1. DIGITAL DELIVERY

Digital products are normally supplied without undue delay after successful payment and order confirmation.

Download access may be provided through the order-confirmation page, email or the customer’s account. Links may be protected, time-limited or subject to a reasonable download limit for security purposes.

Customers must provide a valid email address and are responsible for maintaining access to their account and order email. If a download link fails, contact info@blackcobraminiatures.com with the order number.

  1. RIGHT OF WITHDRAWAL FOR DIGITAL CONTENT

Consumers normally have a fourteen-day right of withdrawal for distance contracts. However, this right is lost for digital content not supplied on a tangible medium once supply begins, provided that the customer:

  • Gives prior express consent for the digital supply to begin during the withdrawal period.
  • Acknowledges that beginning the supply causes the loss of the right of withdrawal.
  • Receives confirmation of that consent and acknowledgement.

The checkout will request this express consent before immediate access to paid digital downloads is provided.

Where these legal conditions have not been met, the customer’s statutory rights remain unaffected.

  1. REFUNDS AND TECHNICAL PROBLEMS

The limitation on withdrawal does not remove the customer’s rights where digital content is defective, incorrectly supplied or not as described.

If a file is corrupted, incomplete or materially different from its description, contact info@blackcobraminiatures.com with the order number and a description of the problem. Black Cobra Miniatures will investigate and, where appropriate, provide a corrected file, replacement, price reduction or refund in accordance with applicable law.

Refunds are not normally offered merely because the customer changes their mind after valid immediate digital delivery has begun and the required express consent and acknowledgement have been given.

  1. DIGITAL-CONTENT CONFORMITY

Digital content will conform to the description and qualities stated on the relevant product page and will be supplied with the functionality and compatibility that a customer may reasonably expect from that description.

Statutory consumer guarantees and remedies for lack of conformity apply and are not limited by these Terms.

  1. LICENCE

Unless a product page or separate licence states otherwise, each purchase grants the customer a personal, non-exclusive, non-transferable licence to download and use the files for private purposes, including printing physical copies for the customer’s own use.

The customer may not:

  • Share, distribute, upload or make the digital files available to another person.
  • Resell, sublicense or commercially exploit the digital files.
  • Sell or distribute modified versions or digital derivatives of the files.
  • Use the files or product images in a manner that infringes intellectual-property rights.

Commercial sale of physical prints is permitted only where an express merchant or commercial licence has been granted.

  1. FREE PRODUCTS

Free downloads remain subject to the applicable intellectual-property and licence restrictions. A zero price does not place a product in the public domain or authorize redistribution.

  1. CUSTOMER ACCOUNTS

Customers may purchase as guests or create an account where available. Account holders are responsible for keeping login credentials confidential and for activity carried out through their account.

Black Cobra Miniatures may suspend access where fraud, file sharing, unauthorized redistribution or other abuse is reasonably suspected.

  1. SUPPORT

Customer-support requests may be sent to info@blackcobraminiatures.com. Include the order number and enough information to identify and investigate the issue.

  1. LIABILITY

Customers are responsible for using suitable slicing software, equipment, materials and safety procedures. Printing results can vary according to printer calibration, resin, filament, supports, settings and user experience.

Nothing in these Terms excludes or limits liability or consumer rights where exclusion or limitation is prohibited by law.

  1. PERSONAL DATA

Personal data is processed as described in the Privacy Policy. Cookie use is described in the Cookie Policy.

  1. CHANGES TO THESE TERMS

The Terms applicable to an order are those made available when the order is placed. Future changes will not retroactively alter completed contracts unless required by law or expressly agreed with the customer.

  1. APPLICABLE LAW AND DISPUTES

These Terms are governed by Spanish law, without depriving consumers of mandatory protections granted by the law of their country of residence.

Consumers may submit complaints by contacting info@blackcobraminiatures.com. Any court proceedings will be brought before the courts determined by mandatory consumer and procedural law.
